What is the difference between a will and a trust?

There are many differences between a will and a trust but the principle difference is that using a will by itself will not avoid the probate process. A will simply identifies how a decedent desires to apportion their estate upon death. If only a will is used, an estate must be opened at the probate court to allow a full decedent’s estate administration.

A trust, on the other hand, is a private testamentary document that, if drafted properly, avoids the public probate estate administration altogether.
