  • the victim is between 13 and 16-years old;
  • force or coercion is used to achieve the sexual penetration;
  • the accused knows or should have known that the victim is mentally incapable, incapacitated or physically helpless;
  • the victim is related to the accused by blood or affinity to the third degree;
  • the victim is between the ages of 16 and 18, is a student at a school, and the accused is a teacher or administrator.

Like CSC 2nd, third degree criminal sexual conduct is a 15-year felony where probation is not a sentencing option; some jail or prison term is required.
